Legal Services for Members Through PDA's Outside General Counsel
PDA’s outside general counsel provides legal services to our members at the same reduced rate offered to PDA, subject to a check to determine whether there are ethical or business conflicts as to other clients or the subject matter that would preclude Eckert Seamans from handling the matter. Please contact Bridget Montgomery of Eckert Seamans, to arrange for an initial 30 minutes of consultation on your specific legal matter, at no cost to you as a member (PDA will pay this expense), by emailing bmontgomery@eckertseamans.com
Your email should include:
- your full name,
- address,
- phone number,
- the name of your dental practice, and
- the nature of the legal matter, along with the name of any person or entity who would be adverse or potentially adverse to you in the matter. For example, if you need legal counsel related to a problem with a vendor, include the name and location of the vendor, whether there is a contract between you and the vendor, and the type of problem (e.g., vendor’s failure to deliver goods for which you have made payment).
Ms. Montgomery will oversee the conflicts check and, if there are no conflicts, arrange for your initial 30-minute consultation, either with her or another Eckert Seamans attorney suited to handle the matter. Should you wish to hire Eckert Seamans to handle the matter beyond the initial consultation, you must execute an engagement letter that sets forth the nature of the matter and the terms and conditions of Eckert Seamans’ representation.
Welcome to the Employment Law Desktop Reference for Dental Offices
provided for members of the Pennsylvania Dental Association by the law firm of Eckert Seamans Cherin & Mellott,LLC.
This Employment Law Desktop Reference for Dental Offices is provided by the law firm of Eckert Seamans Cherin & Mellott, LLC, a regional and national law firm founded and based in Pennsylvania. Eckert Seamans has offices in Philadelphia, Pittsburgh, and Harrisburg, and its lawyers practice throughout the Commonwealth, handling cases and offering advice at one time or another in probably every city and county.
The Pennsylvania Dental Association has a longstanding relationship with Eckert Seamans, and as a result the law firm has agreed to provide this Employment Law Desktop Reference exclusively for members of the PDA to gain an overview of the legal obligations of employers and to give some guidance on how to understand and frame the specific legal questions related to compliance with those obligations on a day-to-day basis. The law firm also has agreed to offer specific legal advice directly to PDA member dental offices in the form of an initial thirty minute consultation that will not incur any fees for the PDA member, and thereafter at a discounted hourly rate that PDA has negotiated for its members. Read details on requesting a consultation at the top of this page.
This Desktop Reference is NOT intended as specific legal advice for a particular situation, even if the situation seems to match perfectly with what is described here. The application of the law and legal principles to a particular set of circumstances requires a lawyer’s training and experience regarding the law itself, as well as a complex analysis of strategic considerations that are woven in and among the nitty gritty of any situation. If you have a legal question or a problem that arises in your dental practice, you should seek legal advice specific to your factual situation, by contacting PDA’s Outside General Counsel, as noted above, or your own private attorney if you have one.
Consequently, the Employment Law Desktop Reference is intended only to guide dental offices to understand when they may need to seek specific legal advice in a particular situation or in planning how to handle a particular type of situation they anticipate facing. That includes in the preparation and implementation of written employment policies and employee handbooks, and the training of Human Resources professionals, managers, and employees on matters relating to employment law. Topics currently covered by the Desktop Reference are listed on the righthand side of this page. Topics that are planned to be added soon are listed below. If you have questions or suggestions regarding the topics offered, or others that you would like to see covered, please email Andrea McCormick at ahm@padental.org
